On April 20, NIADA President Don Griffin, CEO Jeff Martin, and Director of Government Affairs and Compliance Patrick O’Brien met with Federal Trade Commission (FTC) Bureau of Consumer Protection Director Chris Mufarrige and members of his senior leadership team to discuss the FTC’s March 13 warning letters issued to 97 dealerships regarding potential violations of Section 5 of the FTC Act.
During the meeting, NIADA shared some of the feedback independent dealers have expressed since the letters were issued and reaffirmed the association’s support for the FTC’s efforts to promote a dealership marketplace grounded in fairness and transparency. FTC officials also indicated that the agency intends to release additional guidance to provide greater clarity on dealers’ obligations under Section 5. They further encouraged NIADA and its members to share any evidence of potential Section 5 violations they encounter in the marketplace.
