NIADA Privacy Policy

1. Introduction

The National Independent Automobile Dealers Association (“NIADA,” “we,” “our,” or “us”) values your privacy. This policy explains how we collect, use, and share your information when you become a member, participate in events, or interact with our services. All vendor partners promoted by NIADA are independent third parties and have separate privacy policy terms. NIADA only refers members to these partners. We do not own, control or safeguard the information collected by them, and subsequently are not liable for a breach of their data.

2. Information We Collect

We may collect:

· Contact details (name, email, phone number, address)

· Business information (dealership name, title, business address, business web address)

· Event participation details

· Communication preferences

· Online activity data, including IP address, browser type, pages visited, and interactions with NIADA websites and digital platforms.

3. How We Use Your Information

By joining NIADA, receiving industry updates/newsletters or registering for our events, you grant permission for us to:

· Use your information for event-related purposes, including registration, communications, and networking.

· Use your information for business-related purposes, such as industry updates, compliance resources, and member benefits.

· Share your information with NIADA partners and event sponsors for marketing, promotions, and business opportunities relevant to the automotive industry.

· Track and analyze online activity to improve user experience, personalize content, and enhance security.

· Use your information for data analysis, identifying usage trends, determining the effectiveness of promotional campaigns, and to evaluate and improve our services, marketing, and your experience.

4. Sharing Your Information

We may share your information:

· With trusted industry partners who provide products, services, or offers beneficial to members.

· With event sponsors for networking and promotional purposes.

· With service providers who assist in delivering NIADA programs and services.

NIADA does not sell member information to unrelated third parties.

5. Your Privacy Choices & Opt-Out

· Online: Update your preferences in the NIADA Member Portal.

Please allow up to 10 business days for changes to take effect.

6. Data Security

NIADA takes the security of your personal information seriously and implements a variety of safeguards to protect the information we collect and maintain from unauthorized access, use, alteration, disclosure, or destruction. These include:

· Administrative safeguards, such as internal policies, employee training, and access controls that limit data access to authorized personnel with a legitimate business need

· Physical safeguards, such as controlled access to facilities and secure storage of records

7. Limitation of Liability

To the fullest extent permitted by law, NIADA shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use or sharing of your information, including actions taken by third-party partners or sponsors. NIADA’s total liability for any claim related to this policy shall not exceed the amount paid by you for membership during the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless NIADA, its officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

· Your failure to obtain necessary consent for any information you provide to NIADA;

· Any misuse of NIADA services or data by you or your representatives.

9. Changes to This Policy

We may update this policy periodically. Continued use of NIADA services after changes indicates acceptance of the updated policy.
